Terms and conditions

1.1 Scope: These terms govern all contracts with OFFStudio. If you are a business within the meaning of § 14 BGB, your terms do not apply unless we expressly agree in writing. Deviating terms of the customer only apply if we approve them in writing.

1.2 Eversports: Bookings and payments are mainly handled via Eversports (website and app). Eversports is independent from OFFStudio; its terms apply to use of the platform: https://www.eversports.de/h/terms

1.3 Aggregator platforms: If you book through an aggregator platform (e.g. Wellhub (Gympass), EGYM Wellpass, ClassPass, Urban Sports Club), that platform's terms and cancellation/participation rules apply in addition. If platform rules and these terms conflict for booking handling, the rules of the platform you used to book prevail for that booking.

You are responsible for the security of your account and password. If you suspect misuse, contact us at info@offstudios.de. Please keep your details accurate. In justified cases (e.g. breach of these terms, applicable law or house rules) we may suspend or end access.

2.1 Booking: Schedule listings in Eversports are non-binding unless expressly stated otherwise. By booking in Eversports you make an offer; the contract is formed when we confirm or the slot is assigned according to Eversports.

Purchased credits or packages are generally non-transferable, not divisible and personal unless stated otherwise below. Exceptions are at our reasonable discretion; there is no entitlement to an exception.

2.2 First visit: For your first Reformer or Pilates class with us, please arrive at least 15 minutes early for onboarding. Regular Reformer participation may require an intro or a Foundation/All Levels class first. If you have prior experience elsewhere, contact us beforehand (info@offstudios.de); joining Level 2 classes without our consent may not be possible.

2.3 Waitlist: Waitlists run in Eversports. When a spot opens, the system notifies participants per its rules; there is no guarantee of a place. Please book and cancel via Eversports; we generally do not process manual bookings.

Please cancel in the booking system (Eversports, or the respective platform's app for aggregator bookings). For bookings via OFFStudio/Eversports: if you cancel at least 24 hours before the scheduled class start, the booked unit is released back to your credit or package.

If you cancel less than 24 hours before class start or do not attend (no-show), the unit is forfeited. There is no refund or replacement claim in those cases.

Repeated failure to respect cancellation rules or abuse of the booking system may lead to temporary restrictions.

4.1 Attendance: Please be in the studio about 10 minutes before class. If you are late, your spot may be given away; participation is not guaranteed and there is no claim for replacement.

4.2 Availability: We may change classes, substitute instructors or cancel due to low attendance. If we cancel, booked sessions are usually re-credited or rescheduled per Eversports rules; cash refunds only where required by law or booking rules.

Temporary closures (e.g. holidays, renovation) are possible; we will inform you when we can. For time-limited offers, validity may extend for closure periods where legally permissible.

5.1 Regular Reformer monthly membership (8 units): Minimum term is twelve (12) months from contract start. After the minimum term, you may cancel at any time for effect at the next month-end without observing a notice period, unless Eversports or an individual agreement states otherwise.

5.1a Reformer 12-class monthly membership: The membership covers twelve (12) units per billing month at a monthly fee of €150 (gross). Minimum term is twelve (12) months from contract start. No founding member rate applies to this membership.

5.2 Founding membership (Reformer): New founding memberships are no longer accepted. For founding memberships already concluded, a minimum contract term of six (6) months applies from contract start. After the minimum term, you may cancel at any time for effect at the next month-end without observing a notice period. Special price and duration of the benefit follow section 7.1.

5.3 Atelier membership (art): Minimum term is twelve (12) months from contract start. The monthly fee covers an average of four (4) sessions per billing month. Atelier sessions do not take place during Hessian school holidays or on public holidays; this results in roughly 39 sessions per contract year. These breaks are included in the monthly fee and do not reduce the fee or extend the contract term. After the minimum term, you may cancel at any time for effect at the next month-end without observing a notice period unless otherwise agreed. A maximum of ten (10) places are available per atelier class; booking is in order of signup.

5.4 Contract pause: Once per calendar year you may pause your contract for up to four (4) weeks, provided we agree in advance in writing (e.g. email) and it is processed in Eversports as available. We agree start, duration and effect on your package case by case.

5.5 No rollover: Unused units in a membership month (e.g. classes not booked from the monthly allowance) expire at the end of that billing month and are not carried into the next month. There is no automatic make-up or transfer.

5.6 Price adjustments for ongoing memberships: We may change the monthly fee for ongoing Reformer and atelier subscriptions for material reasons (e.g. higher operating costs, change in scope of services, legal or regulatory requirements) with at least six (6) weeks' notice to the end of a month, in text form (email). If the increase exceeds 5% of your previous monthly fee, you may terminate the subscription extraordinarily by the end of the current billing month before the price change takes effect, regardless of any minimum term still running. We will expressly point out this special termination right in the change notice. The founding member rate under section 7.1 is excluded from price increases while your membership runs without interruption.

5.7 Payment: Membership fees are due per the payment method chosen in Eversports at signup. Price and scope follow the offer valid at the time you conclude.

6.1 Reformer trial class: One-off trial; valid for four (4) weeks from purchase unless Eversports shows a different validity; if in doubt, the Eversports entry prevails.

6.2 Reformer drop-in: Single Reformer class booking subject to availability; section 3 cancellation rules apply, as do price and validity per Eversports.

6.3 Reformer 5-class card: Five (5) units; valid for six (6) months from purchase unless set otherwise in Eversports.

6.4 Reformer 10-class card: Ten (10) units; valid for six (6) months from purchase unless set otherwise in Eversports.

6.5 Yoga 10-class card: Ten (10) units for the booked yoga cycle (Tuesdays, 75 min.). The card is tied to a fixed 10-week cycle with fixed start dates communicated in the booking system (Eversports) and on offstudios.de. You join at the next available cycle start. Unused sessions at the end of the cycle are forfeited unless separately agreed.

6.6 Atelier 8-class card / atelier cycle: Eight (8) sessions in the booked atelier cycle with a fixed place assignment. Up to two (2) missed sessions per cycle may be rescheduled with the instructor into the other atelier class of the same cycle if a place is available. Unused sessions at the end of the cycle are forfeited unless separately agreed.

6.7 Atelier trial session: One-off trial for open atelier; bookable once per person. Valid for four (4) weeks from purchase unless Eversports shows a different validity; if in doubt, the Eversports entry prevails. Art materials may be booked optionally on site.

6.8 Further formats: Mat Pilates is currently announced via a waitlist. Once Mat Pilates or other class formats become bookable, the prices, validity and rules shown in Eversports and on the pricing page apply; these terms apply in addition.

7.1 Founding member: The founding member offer is closed to new sign-ups. For founding memberships already concluded, the price is €98 per month (gross) for as long as the membership runs without interruption. Renewals are only available to existing founding members through their ongoing Eversports subscription. When the membership ends, the founding price no longer applies; rejoining is at the regular rates then in force. The minimum contract term in section 5.2 applies.

8.1 Scope: Value vouchers purchased from us that can be redeemed for various services (multi-purpose vouchers) are governed by statutory rules. They are valid for at least three (3) years from the end of the calendar year of purchase, unless the law requires a longer period.

8.2 Delivery: After payment is received, value vouchers are sent as a PDF by email to the address provided in the order process.

8.3 Redemption: Value vouchers can be redeemed for OFFStudio offers bookable via Eversports or on site (Reformer, yoga, atelier). For workshops and kids' art holiday courses only where we expressly offer this at purchase or in the redemption confirmation. Redemption is via the booking system (Eversports) or on site.

8.4 Cash payout and transferability: Cash payout of the voucher value is excluded. Vouchers are transferable unless the voucher or purchase confirmation expressly states “non-transferable”.

8.5 Partial redemption and balance: If you redeem part of the value, the remainder is credited to the voucher and can be redeemed within the validity period. You may top up with other reasonable payment methods if the chosen service costs more than the remaining balance.

8.6 Loss: If you lose the voucher code, we cannot issue a replacement. Please keep your voucher code safe.

9.1 Regular classes: Regular classes are aimed at adults. Participation of minors in adult classes is only possible with prior written consent of a parent or guardian and at our discretion (typically from age 16, accompanied).

9.2 Kids' art holiday courses: Registration is by a parent or guardian via the form on offstudios.de. By submitting the form you make a binding offer to conclude the contract. The contract is formed when we confirm the registration by email and send you a SumUp payment link. The course fee is due within seven (7) days of registration via the SumUp link provided; dates, times and price are as stated in the respective course offer. Until payment is received, the place is not guaranteed. After payment is received and we confirm, the place is booked.

9.3 Cancelling a holiday course: Cancel via the link in your confirmation email on offstudios.de or in writing to info@offstudios.de. If a parent or guardian cancels, we release the place. If payment was already made, we will contact you about a refund or transfer; a cash refund claim exists only to the extent required by law.

9.4 Health and cooperation: The parent or guardian shares relevant allergies, intolerances or special notes before the course starts. Participation is under instructor supervision; medical decisions remain the responsibility of the parent or guardian.

9.5 Other children's offers: For other kids' art dates, section 14 applies unless stated otherwise in the offer.

Commercial filming or photography on our premises only with prior consent. For documentation and marketing, recordings may be made on site in which you appear as part of a group. You may object to the use of your image at any time with effect for the future (e.g. by email to info@offstudios.de); we will honour your objection where technically and legally possible. Named portraits or identification require separate consent.

Content on offstudios.de is protected by copyright. Reproduction or use beyond private use needs our approval.

You participate at your own risk. We are fully liable for intent and gross negligence and for injury to life, body and health. Otherwise, for slight negligence breach of essential duties, liability is limited to typically foreseeable damage as permitted by law. Further liability is excluded where allowed by law.

We are not liable for belongings you bring, except in cases of intent or gross negligence. Please do not leave valuables unattended.

Presentation of classes and products on the site or in Eversports is non-binding unless marked as an offer. Prices are those shown at purchase or booking. All prices are final prices and include the applicable statutory VAT.

Payment is via Eversports, SumUp (link in the confirmation email) or on site, depending on the offer and where we explicitly offer it. The payment methods shown in the booking or signup process apply.

If you are a consumer under the BGB, statutory withdrawal rights may apply to certain distance contracts, unless excluded.

Exclusion for leisure services on a specific date: Under § 312g (2) no. 9 BGB there is no right of withdrawal for contracts for the supply of services related to leisure activities if the contract provides for a specific date or period of performance. This applies in particular to booking individual class places, workshops and holiday courses with a fixed date.

Withdrawal policy: Where a right of withdrawal exists, you may withdraw from this contract within fourteen days without giving reasons. The period is fourteen days from the day the contract was concluded. Sending before the deadline is sufficient.

Early expiry: For contracts for the supply of services, the right of withdrawal also expires if we have fully performed the service and began performance only after your express request and you acknowledged before performance began that you lose your right of withdrawal once the contract has been fully performed.

Effects of withdrawal: If you withdraw, we refund all payments received without undue delay and within fourteen days from receipt of your notice, using the same payment method unless agreed otherwise. We may charge for services already rendered as permitted by law.

End of the withdrawal policy. The model withdrawal form is in Annex 2 to these terms.

14.1 Scope: For workshops, trainings, pop-up events and other specials with their own signup, these terms apply in addition to the details shown in the respective offer (date, price, content).

14.2 Booking via offstudios.de: If you register via a form on offstudios.de, you make a binding offer. We confirm by email and send a SumUp payment link. The place is firmly reserved once payment has been received, unless the offer states otherwise.

14.3 Payment: Due date and payment method follow the confirmation email (usually SumUp). Without payment in time we may cancel the registration and offer the place elsewhere.

14.4 Cancellation: Cancel via the link in your confirmation email or in writing to info@offstudios.de. If payment was already made, we will contact you about a refund or transfer; a cash refund claim exists only to the extent required by law.

14.5 Pop-up events: For free or separately regulated pop-up dates, the conditions on the respective invitation page apply.

14.6 Eversports: Where specials are also bookable via Eversports, those rules apply in addition.

German law applies, excluding the UN Sales Convention. Mandatory consumer protections of the country where you habitually reside remain unaffected if you are a consumer.

If you or we are a merchant, legal entity under public law or special public fund, exclusive place of jurisdiction for disputes from these terms and related contracts is our business seat in Dreieich. Otherwise statutory jurisdiction applies.

We may update these terms for material reasons (e.g. legal changes, service or platform adjustments). We will inform you in good time in text form (e.g. email or clear notice on offstudios.de or in Eversports).

For consumers, consent to a change does not arise from silence alone. Material changes require, where legally required, your express consent or follow statutory rules on contract adjustment. You may object to a change; we will explain legal consequences of an objection (e.g. ordinary termination) where relevant.

For businesses, different rules may apply where permitted.

These house rules are part of these terms. Please follow staff and instructor instructions.

1. Punctuality: Arrive in good time; at least 15 minutes early for your first Reformer class.

2. Check-in: Let the team know when you arrive so we can align attendance with the booking system.

3. Health: Tell us before each session about injuries, conditions or limitations. Participation is your decision in consultation with us; seek medical advice if unsure.

4. Pregnancy: Tell us early for Reformer or intensive Pilates; participation may be limited by stage.

5. Grip socks are required in training areas (Reformer and mat areas as signed). Without suitable socks, participation may be refused.

6. Tie long hair back to avoid catching in equipment.

7. Follow instructions; do not improvise variations that put you or others at risk.

8. Treat equipment with care. After class, clean gear as shown if we provide disinfectant.

9. No glass bottles in the training room. Use lockers or coat racks for large bags and jackets.

10. In the open atelier and art offers, follow posted rules (materials, safety). Be considerate of others and the space.
